Operating a pop-up in New York City offers tremendous opportunity, but the city maintains specific permit requirements for vendors. Understanding these requirements before you apply for an event will ensure a smooth, compliant experience.

The Golden Rule

✓ If you are selling on private property, you do NOT need a city street vendor permit.

Private property includes: warehouses, rooftops, parking lots, inside retail spaces, galleries, and event venues with proper authorization.

Vendor Categories

Food & Beverage Vendors

Prepared food, coffee, baked goods, packaged foods, and non-alcoholic beverages.

  • Food Protection Course Certificate – Online course ($24)
  • Mobile Food Vendor License – Personal ID badge from NYC DCWP
  • Mobile Food Vending Permit – Required for any cart, truck, or mobile unit
  • Commissary Agreement – Proof of commercial kitchen access
📌 Full-term street permits are capped. Many vendors join pre-permitted events to bypass waitlist restrictions.

General Merchandise Vendors

Clothing, accessories, art, home goods, crafts, electronics, and non-consumable goods.

  • At a permitted street fair: Temporary Street Fair Vendor Permit ($10, valid 1 month)
  • On private property: No city permit required
⚠️ The NYC General Vendor License waitlist is currently closed with over 850 applicants. PopUpMia advises vendors to sell exclusively through permitted events.

Fresh Produce Vendors (Green Carts)

Whole, uncut fruits and vegetables only.

  • Green Cart Permit – $75 for a 2-year term
  • Location availability: Brooklyn, Bronx, Staten Island (open); Manhattan, Queens (closed)
  • Veteran exemption: Veterans may bypass waitlist restrictions

The Temporary Street Fair Permit

$10 · Valid for 1 month · Online application via NYC DCWP

This is the most common permit for PopUpMia vendors. When you participate in a permitted street fair, festival, or block party, you do not need the General Vendor License — you simply purchase this $10 temporary permit.

Application timeline: Apply 7–14 days before your first event. The permit covers multiple events within the same 30-day period.

Universal Requirements (All Vendors)

Regardless of permit type or location, every vendor must have:

The NYC Department of Consumer and Worker Protection (DCWP) and NYPD conduct regular enforcement. A $10 permit is significantly less expensive than a minimum $500 fine.

Veteran Vendor Benefits

New York City provides priority access to veteran vendors:

  • Exemption from General Vendor License waitlist
  • Priority processing for food vendor permits
  • Green Cart permit access even in closed areas
  • Reduced or waived application fees

Required documentation: DD214 (Certificate of Release or Discharge from Active Duty)

Pre-Event Compliance Checklist

  • Confirm event location type (private property vs. public space)
  • Verify event organizer has required permits (SAPO for street fairs)
  • Obtain NY State Sales Tax Certificate (if not already held)
  • Purchase Temporary Street Fair Permit ($10) if applicable
  • Food vendors: Complete Food Protection Course and obtain license
  • Secure general liability insurance (or confirm event provides coverage)
  • Print all permits and certificates for on-site display
